Social Care Law Update

Tim Spencer-Lane  A premium session with Tim Spencer-Lane of the Law Commission

 

Aim

A half- or (preferably) one-day training session to give participants an overall understanding of various pieces of social care law, and how they fit together (especially the Mental Capacity Act, DoLS, Care Act and Safeguarding)

 

Target Group

Health or social care staff working in any setting

 

Venue and timings

Your training room, 10.00am – 4.30pm (9.30am – 12.30pm or 1.30pm – 4.30pm for half day sessions)

Learning Outcomes

By the end of this session participants should:

  • Understand recent case law governing how a mental capacity assessment should be carried out
  • Be able to have regard to the person’s wishes and feelings in accordance with recent court decisions
  • Understand the DoLS process and how it operates in practice
  • Have knowledge of how the Supreme Court decision in Cheshire West should be applied in practice
  • Know when a deprivation of liberty will and will not occur in specific settings such as intensive care and domestic settings
  • Understand the care and support journey set out in the Care Act
  • Know the difference between a best interest decision and a Care Act decision
  • Have knowledge of recent case law on how relevant are resources to care planning decisions
  • Understand what the Care Act means by safeguarding
  • Have knowledge of the range of legal safeguarding powers available to health and care services, and other agencies

 

Training Methods Used

This session can be run as a training session for groups of up to 20 participants (involving plenty of groupwork, discussion etc), or as an interactive presentation for a large audience (involving questions and answers and some pairs or groupwork). Either way, we want participants to leave the session saying “that was really enjoyable – and it was directly relevant to my working life.”
